What is VAWA?

VAWA (Violence Against Women Act) allows certain victims of abuse by U.S. citizens or lawful permanent residents to apply for legal status without their abuser’s knowledge or participation.

Who qualifies for VAWA?

You may qualify if you are:

  • A spouse, child, or parent of a U.S. citizen or green card holder

  • A victim of battery or extreme cruelty by that relative

  • Living in the U.S. or recently left

  • Able to demonstrate good moral character

Can men apply under VAWA?

Yes. Despite the name, VAWA protects all genders. Men, women, and non-binary individuals can qualify if they meet the eligibility requirements.

Will my abuser find out I applied?

No. VAWA is a confidential process. The abuser is not notified or contacted by USCIS at any point during the petition.

Can I still apply if I'm divorced?

Yes. If the divorce was connected to the abuse and occurred within 2 years before filing, you may still be eligible.

What happens if my VAWA petition is approved?

You may be eligible to apply for a work permit, receive deferred action, and eventually adjust your status to become a lawful permanent resident (green card holder).
